Alabama to execute triple murderer who survived 2022 lethal injection attempt

Alabama Governor Kay Ivey has set an execution date for the convicted triple murder killer who survived a botched 2022 attempt to execute him.

Ivey’s office said the execution of Alan Eugene Miller will be carried out between midnight on September 26 and 6 a.m. September 27.

Miller was convicted in the 1999 killings of three men who he shot at his workplace. Miller will be executed by nitrogen hypoxia.

In 2022, Alabama attempted to execute Miller by lethal injection but called off the execution after personnel struggled to get IV lines started on Miller.

Miller would be only second condemned man to be executed by nitrogen hypoxia. The first was in January when the state executed Kenneth Smith with the previously untested method.

Witnesses said Smith appeared to shake and convulse during the execution leading critics to suggest the execution method should be considered cruel and unusual punishment.
