A robber was shot and killed outside an Alabama gas station Monday night after a citizen who was once and active duty Marine spotted the robber and confronted the man.

Limestone County Sheriff’s Office deputies reported that a store robbery occurred in Athens, Alabama, leading to all area law enforcement searching for the suspect.

A short time later a man later identified as James Lee Henry, 53, of Collegeville, Pennsylvania, entered a gas station in Ardmore, Alabama, armed with a handgun and committed a second robbery.

A Good Samaritan armed with a legal personal weapon saw the robbery being committed and as Henry exited the store, the Good Samaritan ordered Henry to drop his gun. When Henry failed to comply and begin pointing his weapon at the man who was formerly an active duty U.S. Marine fired and shot Henry.

Henry was pronounced dead at the scene.

Deputies said the stolen money from both robberies was found at the scene.

The incident is under investigation but no arrests have been made. After the investigation is completed, evidence will be reviewed by a Limestone County Grand Jury, police said.
