State prosecutors have filed court documents saying they intend to seek the death penalty against the suspected killer of an Alabama police officer.

Marco Perez is charged with capital murder in the January death of 30-year-old Mobile Police Officer Sean Tuder. Authorities have said Tuder was shot during a struggle with Perez.

WKRG-TV reports on Tuesday, prosecutors also filed a motion to consolidate the case against the 19-year-old who faces several other charges including theft, receiving stolen property, and unlawful breaking and entering. Investigators have said the gun used to kill Tuder was stolen from an unlocked car.

Perez has pleaded not guilty.

Tuder is among three officers killed in Alabama this year. The other officers are Birmingham police Sgt. Wytasha Carter and Auburn police Officer William Buechner.
